3.3 Prohibited Content: You may not submit User Content that is illegal, offensive, defamatory, discriminatory, or violates the rights of others. Darcia CMB reserves the right to remove or disable any User Content that violates this provision
4.1 Disclaimer: The Services are provided on an “as is” and “as available” basis without any warranties, express or implied. Darcia CMB disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
4.2 Limitation of Liability: In no event shall Darcia CMB be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the Services or this Agreement, even if advised of the possibility of such damages. Darcia CMB’s total liability under this Agreement shall not exceed the amount paid by you, if any, for using the Services.
You agree to indemnify, defend, and hold harmless Darcia CMB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your use of the Services or any violation of this Agreement.
